General Terms of Business for the Lindner Nights Programme

The following terms and conditions regulate the customer advantage program “Lindner Nights” (hereinafter “LN”) of Lindner Hotels AG (hereinafter called “Lindner”). Participation in LN gives guests the opportunity to collect points through overnight stays which they can then redeem for subsequent overnight stays.

It is a condition of participation in LN that the guest completes the application form truthfully in writing or online at www.lindner.de/nights and sends it to Lindner, and that Lindner does not refuse the application within a period of two weeks. No reasons for refusal of an application have to be given. Participation in LN is free of charge. By registering for LN, guests declare that they agree to the following conditions of participation, and in particular to the collection, storage and processing of personal data. Lindner will comply with all data protection regulations.

After receipt of the application (the date the Lindner Nights card application is received by post or handed in at the reception desk) and if the application is not refused by Lindner, Lindner shall set up an LN Account for the guest. No points shall be credited for services utilized prior to this point in time. Any individual who has reached the age of 18 years is entitled to participate in LN. Multiple registrations are not permitted. There is no legal right to participation. Employees of Lindner or its associated companies are not entitled to participate.

Around four weeks after receipt of the application form by Lindner the guest shall receive a customer card through the post. The customer card is not transferable.

Card-holding guests receive LN points for Lindner services under the following conditions:
1. The cardholder receives services personally or for no more than five other people per stay.
2. Services rendered for the cardholder or a third party are paid for by the cardholder.
3. Services provided by Lindner are rendered as part of an overnight stay by the cardholder.

Cardholders must present their card prior to payment. Cardholders receive 10 LN points for each whole euro they spend. Excluded payments for external costs e.g. local taxes, charges, tourist tax and similar. Foreign currencies are converted in-house based on the current valid exchange rate. LN points are non-transferable.

Other customer programs (e.g. Miles & More) and LN points cannot be credited simultaneously. The guest shall receive no LN points for cash expenditure or for services that are booked through a tour operator or travel agency or for stays that are charged on crew or special conditions or as group bookings. No points shall be credited for services that the guest settles by means of a points redemption with vouchers (from a tour operator or travel agency) or by credit notes. Collected LN points shall be deleted 24 months after crediting if they have not been redeemed by then.

Collected LN points can be converted into overnight bonuses. The current bonus summary can be found at www.lindner.de/nights. The longest-standing points shall always be converted first. The conversion of points into monetary value and any pay out or offsetting is excluded. The redemption of an LN bonus requires that the guest makes a booking with the LN team. Redemption of points cannot be undertaken on the spot in a hotel. Bonus redemptions are not transferable. Redemptions are possible on request and depending on availability. During trade-fair and high-season periods in the relevant hotel there may be limited or no availability for redemptions. A maximum of four nights per planned stay may be redeemed or included as a bonus. When an overnight stay is booked the corresponding number of points shall be deducted from the participant’s account. Once points have been redeemed they cannot be re-converted or exchanged for another bonus.

At the end of each quarter, card holders shall receive notification of their current points total by e-mail. In addition, card holders can check their points status online at any time by logging on to www.lindner.de/nights using their customer number and password. Card holders who do not give an e-mail address can find out their points status from the LN Team. A card holder’s points status shall be deemed to be correct and complete if the card holder does not object within four weeks of receipt of notification of his or her points status or of a request for such information.

The guest is liable in the event of the loss of his or her participant’s card and he or she must inform Lindner about the loss of the card without delay. On request Lindner shall issue the guest with a new card and cancel the lost card.

Guests may terminate their participation at any time to the end of a month without the need to give notice or to state the reasons for such termination. Termination must be made in writing or by e-mail. Upon termination the guest has the right to a bonus amounting to the value of the points collected up to the date of termination. Points which have not been redeemed are forfeited without compensation upon termination of the contract. If the bonus program is terminated by Lindner, a reasonable period of notice shall be observed. If there is no activity on a points account for 36 months (credits or redemptions), the contract between the guest and Lindner shall end with effect to the end of the next month.

If use is made of services of a cooperation partner of Lindner, the general terms of business of the cooperation partner are applicable. Lindner Hotels AG is not liable for the products and services of the cooperation partner.

When the contract ends the guest is obliged to render his or her customer card unusable. Lindner reserves the right to close the bonus programme at any time without giving reasons or to replace it with another programme. Closure or replacement of the programme shall not give rise to any compensation claims on the part of the guest. The place of jurisdiction is Düsseldorf. In the event of any breach of these terms and conditions the guest’s account shall be closed and the bonus points contained therein shall be forfeited.
